Terms of Service

LAST UPDATED 27 OCTOBER 2026

Mendicant runs on your machine, under your control, and we do not store any of your data. You are responsible for what you ask it to do and for the services you connect it to. The software is provided as is.

These terms ("Terms") are an agreement between you and the makers of Mendicant ("we", "us"). By downloading, installing or using the Mendicant desktop app, iOS app or mendicantd daemon (together, "the Software"), or by using this website, you agree to them. If you do not agree, do not use the Software.

1. Your licence

We grant you a personal, non-exclusive, non-transferable, revocable licence to install and use the Software on devices you own or control, for personal or internal business purposes, subject to these Terms.

You may not sell, rent, sublicense or redistribute the Software, remove its notices, or use it to build a competing product. Open-source components bundled with the Software (such as llama.cpp and whisper.cpp) are licensed under their own terms, which take precedence for those components.

2. No accounts and no data held by us

Mendicant has no user accounts. We do not collect, store or have access to your conversations, files, recordings, email, credentials or any other data you use with the Software. It all stays on your device or on devices you connect. Details are in our Privacy Policy, which forms part of these Terms.

This also means we cannot recover your data. If you lose a device, delete Mendicant's folders or lose access to your Keychain, we have no copy to restore. Back up what matters to you.

3. Models and AI output

Mendicant runs language, speech and embedding models that you choose and download, or that you reach through providers you configure. We do not make those models. Each is subject to its own licence, and some (for example certain text-to-speech voices) are licensed for non-commercial use only. You are responsible for complying with the licence of every model you use.

AI output can be wrong, incomplete, outdated or offensive. Do not rely on it for medical, legal, financial, safety-critical or other decisions where an error could cause harm without checking it yourself.

4. Tools and actions on your machine

Mendicant can read files you grant it, run shell commands, browse the web, send email, create calendar events and call tool servers you install. Actions that change something, such as running a command, writing a file or sending a message, require your approval before they run.

You are responsible for what you approve. Read each approval before you accept it. Granting a folder, approving a tool server or approving a command gives the Software the access you chose; it is not a sandbox. We are not responsible for loss or damage resulting from actions you approved or access you granted.

5. Third-party services

You can connect the Software to services we do not operate, including remote model providers (such as OpenAI, Anthropic, OpenRouter or Groq), Google, Hugging Face, search engines, FlightAware, AfterShip, Tailscale and Apple Push Notification service. Your device talks to them directly, using your own credentials where needed. Your use of each is governed by that service's own terms and privacy policy, and you are responsible for any fees they charge. We are not responsible for their availability, content or conduct.

6. Acceptable use

Do not use the Software to:

7. Updates

The desktop app checks releases.mendicant.ai for updates and asks before installing one. Updates may add, change or remove features. We are not obliged to provide updates, support or any particular feature, and we may stop distributing the Software at any time. Versions you already have keep working on your device.

8. Your content

You own your content: your prompts, files, recordings and everything the Software produces for you. We claim no rights to it, and because it never reaches us, we cannot see, use or share it.

The Software itself, including its name, logo and design, belongs to us and is protected by intellectual property law. These Terms give you no rights to it beyond the licence in section 1.

9. Feedback

If you send us suggestions or bug reports, you agree we may use them to improve Mendicant without owing you anything. Please don't include personal data you don't want us to have. If you email us, we keep your message only as long as we need it to reply.

10. Disclaimer of warranties

THE SOFTWARE AND THIS WEBSITE ARE PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED OR STATUTORY, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SOFTWARE WILL BE ERROR-FREE, SECURE OR UNINTERRUPTED, OR THAT ITS OUTPUT WILL BE ACCURATE.

11. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF DATA, PROFITS, REVENUE OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SOFTWARE, EVEN IF WE WERE TOLD SUCH DAMAGES WERE POSSIBLE. OUR TOTAL LIABILITY FOR ANY CLAIM IS LIMITED TO THE GREATER OF THE AMOUNT YOU PAID US FOR THE SOFTWARE IN THE PRECEDING 12 MONTHS OR US$50.

Some jurisdictions do not allow these exclusions or limits, so some of them may not apply to you. Nothing in these Terms limits liability that cannot be limited by law, or any rights you have as a consumer that cannot be waived.

12. Indemnity

To the extent permitted by law, you agree to indemnify us against claims, losses and costs (including reasonable legal fees) arising from your breach of these Terms or your misuse of the Software.

13. Termination

You can stop using the Software at any time by uninstalling it and deleting its folders. Your licence ends automatically if you breach these Terms. Sections 2, 3, 8 and 10 to 15 survive termination.

14. Changes to these Terms

We may update these Terms. We will post the new version here and change the date at the top. If a change is material, we will say so in the app or on this site before it takes effect. If you keep using the Software after that, you accept the updated Terms.

15. General

If any part of these Terms is found unenforceable, the rest stays in effect. Our failure to enforce a term is not a waiver of it. You may not transfer these Terms without our consent. These Terms, together with the Privacy Policy, are the entire agreement between you and us about the Software.
